Welcome to ugocycle.com. These terms and conditions of sale govern the relationship between UGO Cycle Inc, registered in Quebec under number NEQ 1175256420, having its head office at 2-5335 rue Albert Millichamp, Saint-Hubert, Quebec, J3Y 8Z8, and any person making a purchase via the ugocycle.com website, in store or from an authorized dealer. 

 

  1. PURPOSE AND ACCEPTANCE OF CONDITIONS

These general terms and conditions of sale define the rights and obligations of the parties in connection with the online and in-store sale of products offered by UGO Cycle Inc. including electric bicycles, electrification kits and accessories. 

All orders placed on our website, in store or with an authorized dealer imply unreserved acceptance of the present terms and conditions of sale.📄 Privacy policy and warranty conditions are available separately:

     2. PRODUCTS AND AVAILABILITY 

  • The essential characteristics of the products are described on the product sheets and are updated regularly. 
  • Products are offered while stocks last. Availability is not guaranteed before order confirmation. 
  • In the event of unavailability after validation of the order, the customer will be informed as soon as possible and will be able to choose between : 
  • A full refund of your purchase. 
  • Delayed delivery depending on product availability. 
 

Order cancellation before shipment : 

If you wish to cancel an order before shipment, please contact our customer service department at info@ugocycle.com as soon as possible. All cancellation requests after shipment will be subject to the return conditions specified in article 5. 

Prices, product descriptions and availability are subject to change without notice. We reserve the right to correct any errors in display, product information or availability at any time. 

 

  1. PRICE AND PAYMENT
 

All prices are in Canadian dollars (CAD), excluding taxes. Applicable taxes (GST and QST) are added at checkout. 

Prices are subject to change without notice. In the event of an obvious pricing error on our website or in store, UGO Cycle Inc. reserves the right to cancel the order and refund the customer in full. 

 

Means of payment accepted : 

  • Online : Credit card (Visa, Mastercard, American Express). 
  • In store : Credit card, cash, bank transfer.
 

Delivery charges : 

  • Electrification kit : 49 $ 
  • Bikes : 99 $ 
  • Parts, accessories, components : Calculated according to weight and destination. 
 

These charges apply to addresses within the province of Quebec, except for certain remote areas. For deliveries outside Quebec or to remote areas, additional charges may apply. An estimate will be provided at checkout. 

 

Order cancellation before shipment 

If you wish to cancel an order before it has been shipped, please contact our customer service department at info@ugocycle.com as soon as possible. If the order has not yet been shipped, a full refund will be made. After shipment, the return conditions specified in article 5 apply. 

 

Reimbursement of delivery costs 

Delivery charges are non-refundable, except in the event of an error on our part or if a defective product is returned under our warranty policy.

  1. DELIVERY

We work with reputable carriers to ensure fast, reliable service. Once your order has been dispatched, a tracking number will be sent to you. We cannot be held responsible for carrier-related delays (strikes, weather conditions, high demand, etc.), but we will assist you in the event of a problem. 

Orders are processed within : 

 

  • 1 to 3 days for electrification kits, parts and accessories, after receipt of payment. 
  • 3 to 5 working days for electric bikes, upon receipt of payment. 
 

Delivery time depends on your location and the carrier selected. An estimate will be provided at checkout. 

We pay particular attention to the packaging of our bikes and components to minimize the risk of damage during transport. 

 

Delivery problems and recourse 

If a problem occurs when you receive your order, please follow the steps below: 

  • Before accepting delivery If the box is badly damaged, take photos in the presence of the delivery person and refuse delivery. 
  • If you accept the package despite visible damage Please note the details of the damage on the delivery note, take photos and contact us immediately. 
  • Lost or undelivered parcels If your order does not arrive within the estimated time, please contact us at info@ugocycle.com so that we can assist you in following up with the carrier. If the parcel is confirmed as lost, a full refund will be made. 
 

 Returns and refunds in the event of dissatisfaction 

 

If you wish to return a product for any reason other than shipping damage, please refer to our return policy in section 5 of these terms and conditions. 

 

Return packaging 

All returns or exchanges must be made in its original packaging and in good condition to qualify for a refund or replacement. 

 

Time limit for reporting a problem 

Any delivery problem (damage, lost parcel, order error) must be reported under 5 working days after receipt à info@ugocycle.com to be taken care of. 

 

If you require additional insurance, please contact us before shipment or ask the carrier. 

 

  1. RIGHT OF WITHDRAWAL, RETURNS & REFUNDS

We adhere to rigorous quality standards and want you to have a positive customer experience. All sales are final, but in the event of a defective product, we implement a simplified return process. 

 

Deadlines for reporting defects and requesting returns 

All defects must be reported within 10 days of receipt of the product in order to be covered by the warranty. 

Products eligible for returns 

Only products with a proven defect can be returned according to the following procedure: 

  1. Contact us to info@ugocycle.com with a description of the problem and photos or videos of the product concerned. 
  1. The product must be returned in its original packaging and in good condition. Electrification kits must not have been installed. 
  1. We will provide a pre-paid return label to facilitate the return of the product. 
  1. After inspection, if the defect is confirmed, we will replace it and pay the return shipping costs. 
  1. If no fault is found, the product will be returned and shipping costs may be charged. 
 

No cancellations or voluntary returns 

  • No returns or refunds will be granted for personal convenience or change of mind. 
  • No exchange will be accepted for a functional product. 
 

Return packaging 

  • Returned products must be complete, in perfect condition and in their original packaging. 
  • Electrification kits must not have been installed. 
  • Any damaged or incomplete product may be refused.

  1. WARRANTY PROCEDURE

Proof of purchase is required for warranty service. The purchaser must contact our customer service department at info@ugocycle.com to report a problem with your product. 

  • Depending on the nature of the problem, a solution may be proposed immediately by telephone or e-mail, without the need to return the product. 
  • If a return is required, a Return Merchandise Authorization (RMA) will be assigned and a prepaid return label provided.

Limited warranty on products 

  • 12 months on the electrical components bicycles (motor, battery, controller, display, wiring, charger). 
  • 12 months on the mechanical components bicycles (wheels, fork, headset, handlebars, saddle, transmission). This warranty covers only manufacturing defects and not normal wear and tear. 
  • 60 months (5 years) on the frames and forks against manufacturing defects. 
 

Any problem covered by the warranty must be reported as soon as it occurs and before the expiry of the applicable warranty period. 

The warranty is granted exclusively to the original purchaser and is not transferable to a subsequent owner. 

 

  1. LIMITATIONS AND EXCLUSIONS OF LIABILITY

Installation and assembly 

  • The installation of a electrification kit must be carried out in accordance with the instructions supplied. 
  • The assembly of a boxed bike is the responsibility of the purchaser, who must take all necessary steps to ensure proper installation. 
  • We strongly recommend that installation or assembly is carried out by our stores or an authorized dealer to ensure optimum safety and operation. 
  • All modification, incorrect installation or improper use may invalidate the warranty and exclude any liability on our part.
 

 Liability exclusions 

  • UGO Cycle Inc. cannot be held responsible for any damage caused by the use of its products. direct, indirect, incidental or consequential resulting from the use of its products, except in the case of proven manufacturing defect. 
  • We are not responsible for personal injury, property damage or financial loss resulting from the use of our products. non-compliant manufacturer's recommendations. 
  • The buyer is entirely responsible for comply with local laws and regulations governing the use of products, in particular with regard to electric bikes and their certification on the public highway. 
  • How to use winter in difficult road conditions (snow, ice, road salt, extreme temperatures) can accelerate wear on mechanical and electrical components. The purchaser is responsible for maintenance appropriate to these conditions. 
  • Use of bicycles or electrification kits for commercial purposes (delivery, rental, transport of heavy loads) can result in faster wear and will not be covered by the warranty if wear exceeds the normal use foreseen by the manufacturer. 

 

  1. APPLICABLE LAW, PRICE ACCURACY AND DISPUTE RESOLUTION
 

Applicable law and competent courts 

  • These terms and conditions of sale are governed by the laws of France. province of Quebec and applicable laws of Canada. 
  • The parties elect domicile in the Montreal judicial district for the hearing of any claim arising from the interpretation, application or validity of these GCS. 
  • The language used by UGO Cycle Inc. is French. 
 

Price accuracy 

  • UGO Cycle Inc. makes every effort to post accurate and up-to-date prices on its website and in-store. 
  • If a obvious pricing error after the order has been placed, UGO Cycle Inc. may cancel order and refund the customer in full. 
  • In stores, if a displayed price is incorrect, the Quebec Price Accuracy Policy applies : 
  • If the item costs 10 $ or lessis offered free of charge. 
  • If the item costs more than 10 $the adjusted price will be that displayed minus 10 $. 
 

 Mediation and dispute resolution 

  • In case of litigationthe parties undertake to give preference to a amicable resolution before taking any legal action. 
  • Failing amicable settlement, mediation will be offered via a recognized organization before any legal proceedings. 

 

  1. CHANGES TO THE GENERAL TERMS AND CONDITIONS OF SALE
 
  • UGO Cycle Inc. reserves the right to amend these GTC at any time, without notice, to reflect legislative, commercial or technological changes. 
  • Orders placed before an update remain subject to the conditions in force at the time of purchase. 

 

  1. INTELLECTUAL PROPERTY
 

Intellectual property rights 

  • All content on the site UGO Cycle Inc. (texts, images, logos, videos) are the exclusive property of UGO Cycle Inc. or used with the authorization of their owners. 
  • Any reproduction or use without written authorization is strictly prohibited. 
 

User-submitted content 

  • By sharing a review, photo or testimonial, the user authorizes UGO Cycle Inc. to use them for promotional or advertising purposes.

  • These General Terms and Conditions constitute the full agreement between UGO Cycle Inc. and the purchaser. 
  • In case of conflict between the French and English versions of the T&Cs, the French version prevails.
